    Comitium AI Terms of Use

    These Terms of Use (“Terms”) govern your access to and use of the products, services, websites, models, APIs, and applications provided by Comitium AI, Inc. (“Comitium AI”, “we”, “us”, or “our”). By using our Services, you agree to these Terms. If you are using the Services on behalf of an organization, you represent that you have authority to bind the organization to these Terms. If you do not agree to these Terms, do not access or use the Services.

    1. The Services

    Comitium AI provides artificial intelligence systems, models, APIs, tools, and associated software (collectively, the “Services”). We may update or modify the Services at any time, including altering, suspending, or discontinuing features.

    2. Eligibility

    You may use the Services only if you:

    are at least 18 years old,

    can form a binding contract under applicable law, and

    comply with these Terms and all applicable laws and regulations.

    If you use the Services on behalf of an entity, you agree that the entity is legally responsible for your use.

    3. Your Content

    3.1 Ownership

    You retain ownership of all content, data, text, prompts, instructions, and other materials you submit to the Services (“User Content”).

    3.2 License to Us

    You grant Comitium AI a worldwide, royalty-free, sublicensable license to use, store, reproduce, analyze, and process User Content solely for the following:

    providing and improving the Services,

    ensuring safety, security, and abuse monitoring,

    complying with laws and enforcing policies.

    We do not use your User Content to train models unless you provide explicit permission (e.g., via a settings interface or enterprise agreement).

    4. Output

    The Services may generate text, data, or other materials (“Output”).
    Subject to these Terms, you may use Output for any lawful purpose, including commercial use.

    4.1 Output May Be Inaccurate

    Output may be incomplete, incorrect, outdated, or misleading.
    You are responsible for reviewing and verifying all Output.

    5. Acceptable Use

    You agree not to use the Services in ways that:

    5.1 Illegal or Harmful Activity

    violate laws or regulations;

    involve fraud, deception, or unlawful surveillance;

    impersonate individuals or entities;

    exploit minors or vulnerable groups.

    5.2 High-Risk Uses

    You may not use the Services for:

    medical diagnosis or clinical decision-making,

    legal or financial advice without human professional oversight,

    autonomous control of safety-critical systems,

    weapons development,

    disinformation, election manipulation, or malicious influence.

    5.3 Interference and Abuse

    You may not:

    reverse-engineer, extract, or attempt to copy our models or datasets;

    bypass rate limits or security systems;

    use Output to build competing AI models;

    misrepresent Output as human-generated where disclosure is required.

    6. Accounts and Security

    You are responsible for protecting your account and ensuring all activity complies with these Terms.
    Notify us immediately of unauthorized access.
    We may suspend accounts that pose security or legal risks.

    7. Privacy

    Comitium AI’s handling of personal data is governed by our Privacy Policy, incorporated into these Terms.

    8. Intellectual Property

    8.1 Our Rights

    Comitium AI retains all rights to:

    the Services,

    models, algorithms, and software,

    documentation and proprietary content,

    trademarks, logos, and brand assets.

    Except as expressly stated, these Terms do not grant any rights to our intellectual property.

    The Services may integrate or rely on third-party tools or content. Comitium AI is not responsible for their performance, policies, or security.

    10. Service Availability

    We aim for reliability but do not guarantee:

    uninterrupted access,

    error-free operation,

    data retention.

    We may perform maintenance or updates without notice.

    11. Modification of Terms

    We may change these Terms at any time.
    Material changes will be communicated, and continued use of the Services constitutes acceptance.

    12. Termination

    We may suspend or terminate your access if:

    you violate these Terms,

    Upon termination, all rights under these Terms end immediately.

    Comitium AI disclaims all warranties, express or implied, including:

    14. Limitation of Liability

    Comitium AI is not liable for indirect, incidental, consequential, or punitive damages.

    Our total liability for any claim will not exceed the greater of:

    the amount paid by you in the past 12 months, or

    $100.

    Some jurisdictions may not allow certain exclusions.

    You agree to indemnify and hold harmless Comitium AI from claims, damages, liabilities, and legal fees arising from your:

    use of the Services,

    violation of these Terms,

    infringement of intellectual property or other rights.

    These Terms are governed by the laws of the jurisdiction in which Comitium AI is incorporated, excluding conflict-of-law principles.
    Disputes will be resolved through binding arbitration unless prohibited by law.
