    Comitium AI Terms of Service

    These Terms of Service (“Terms”) govern your access to and use of the products, software, APIs, applications, and services provided by Comitium AI, Inc. (“Comitium AI”, “we”, “us”, or “our”). By accessing or using the Services, you (“Customer”, “you”, or “your”) agree to be bound by these Terms.

    If you are entering into this Agreement on behalf of an organization, you represent that you have authority to bind that organization.

    1. Definitions

    “Services” means Comitium AI’s products, models, APIs, software, and related offerings.

    “User Content” means data, prompts, files, documents, and any content you submit to the Services.

    “Output” means text, data, or other information generated by the Services in response to User Content.

    “Authorized Users” means individuals permitted by you to access or use the Services.

    2. Access to the Services

    Comitium AI grants you a limited, nonexclusive, non-transferable, and revocable license to access and use the Services in accordance with these Terms.

    We may update, enhance, or modify the Services at any time, including adding or removing features or limits.

    3. Account Registration

    To use certain Services, you must create an account. You agree to:

    provide accurate information,

    keep credentials confidential,

    ensure Authorized Users comply with these Terms.

    You are responsible for all activity under your account.

    4. User Content

    4.1 Ownership

    You retain all ownership rights to your User Content.
    Comitium AI does not claim ownership over User Content.

    4.2 License to Comitium AI

    You grant Comitium AI a worldwide, royalty-free license to use, host, store, reproduce, analyze, and process User Content solely for:

    providing, maintaining, and improving the Services,

    ensuring Service safety and security,

    complying with legal requirements.

    We do not use User Content to train our models unless you grant explicit permission.

    5. Output Rights and Responsibilities

    Subject to compliance with these Terms, you may use Output for any lawful purpose, including commercial use.

    You acknowledge that:

    Output may be inaccurate, incomplete, or inconsistent.

    You are responsible for evaluating Output and ensuring it is used responsibly.

    Comitium AI may generate similar Output for other users based on similar inputs.

    6. Acceptable Use

    You agree not to use the Services to:

    6.1 Harm, Illegality, or Deception

    violate laws or regulations,

    commit fraud, surveillance, or impersonation,

    exploit minors or vulnerable individuals.

    6.2 High-Risk Activities

    medical, legal, or financial advice without professional oversight,

    autonomous or safety-critical decision-making,

    weapons development,

    disinformation campaigns, political manipulation, or election interference.

    6.3 System Misuse

    reverse engineer or extract models,

    bypass usage limits or security controls,

    develop competing AI models using our Outputs,

    interfere with Service performance or infrastructure.

    Violation of these rules may result in suspension or termination.

    7. Fees and Payment

    If you purchase paid Services:

    Fees are specified at the time of purchase.

    Payments must be made using a valid payment method.

    All fees are non-refundable unless required by law.

    We may modify pricing with reasonable prior notice.

    8. Service Availability

    We aim to provide reliable Services but do not guarantee:

    uninterrupted uptime,

    error-free performance,

    preservation of User Content or Output.

    We may perform maintenance or updates without notice.

    9. Security and Data Protection

    We implement industry-standard security measures to protect data.
    However, no system is completely secure.

    You are responsible for:

    securing your devices,

    controlling access to your account,

    ensuring your use complies with applicable data laws.

    10. Confidentiality

    Each party agrees to protect the other party’s confidential information with reasonable care.
    Confidential information does not include information that is:

    publicly available,

    rightfully received from a third party,

    independently developed,

    required to be disclosed by law.

    11. Intellectual Property

    Comitium AI retains all rights to:

    its models, software, systems, datasets, and architecture,

    documentation and design,

    trademarks, logos, and proprietary content.

    No intellectual property rights are transferred except those expressly granted.

    12. Third-Party Services

    The Services may integrate with third-party offerings.
    Comitium AI is not responsible for:

    third-party content,

    their products or failures,

    their privacy or security practices.

    13. Termination

    Comitium AI may suspend or terminate access if:

    you violate these Terms,

    your use poses operational, legal, or safety risks,

    required by law.

    Upon termination:

    your right to use the Services ends immediately,

    we may delete User Content and account data as permitted by law.

    14. Disclaimers

    The Services are provided “as is” and “as available.”
    Comitium AI makes no warranties, express or implied, regarding:

    accuracy,

    reliability,

    fitness for a particular purpose,

    non-infringement.

    15. Limitation of Liability

    To the fullest extent permitted by law:

    Comitium AI is not liable for indirect, incidental, consequential, special, or punitive damages.

    Our total liability under these Terms will not exceed the greater of:

    amounts paid by you in the past 12 months, or

    $100.

    Some jurisdictions do not allow certain limitations; in those cases, these limits apply to the maximum extent permitted.

    16. Indemnification

    You agree to defend, indemnify, and hold harmless Comitium AI from claims, damages, losses, and expenses arising out of or related to:

    your use of the Services,

    your violation of these Terms,

    your infringement of third-party rights.

    17. Governing Law and Dispute Resolution

    These Terms are governed by the laws of the jurisdiction in which Comitium AI is incorporated, without regard to conflict-of-law principles.

    Disputes will be resolved through binding arbitration, unless prohibited by law.

    We may amend these Terms at any time.
    Material changes will be communicated via email or website notice.
    Continued use of the Services constitutes acceptance of the updated Terms.
